Terms of Service

1. Eligibility

You must be at least 18 years of age, or have the consent of a parent or legal guardian, to use the Service. By using the Service you represent that you meet this requirement.

2. Accounts

You may create an account using your email address or by signing in with Google. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at info@appleguy.mw if you suspect unauthorised access.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or remain inactive for an extended period.

3. Google Sign-In

We offer Google Sign-In as a convenient authentication option. By using Google Sign-In you authorise us to receive your Google account's basic profile information (name, email address, and profile picture) solely for the purpose of creating and managing your account on the Service. We do not access any other Google account data. Your use of Google Sign-In is also subject to Google's own Terms of Service and Privacy Policy.

4. Products and Pricing

All products listed on the Service are subject to availability. We reserve the right to modify or discontinue any product at any time without notice.

Prices are displayed in Malawian Kwacha (MWK) and are inclusive of applicable taxes unless stated otherwise. We make every effort to ensure pricing accuracy; however, in the event of a pricing error we reserve the right to cancel the affected order and issue a full refund.

All Apple products sold by AppleGuyMw are 100% genuine and sourced from authorised distribution channels. AppleGuyMw is an authorised Apple reseller.

5. Orders and Payment

• Placing an order constitutes an offer to purchase. Your order is confirmed when you receive an order confirmation email.
• We accept the payment methods listed at checkout. Payment must be made in full before an order is dispatched.
• We reserve the right to refuse or cancel orders at our sole discretion, including where we suspect fraud or where stock is unavailable.
• If a payment fails or is reversed, your order may be cancelled and the items returned to stock.

6. Delivery

We deliver across Malawi, with same-day or next-day options available in Blantyre and Lilongwe. Delivery timeframes are estimates and may be affected by factors outside our control. Risk of loss and title pass to you upon delivery.

Free delivery thresholds and delivery fees, if applicable, are displayed at checkout and are subject to change.

7. Returns and Refunds

We want you to be completely satisfied with your purchase. Our returns policy, including eligibility criteria and process, is set out on our Returns Policy page. In summary:

• Items may be returned within 7 days of delivery if they are unused, in original packaging, and accompanied by proof of purchase.
• Defective or incorrectly described items are eligible for a full refund or exchange.
• Software, digital downloads, and opened accessories are non-returnable unless defective.
• Refunds are processed within 5–10 business days of receiving the returned item.

8. Warranty

Apple devices purchased from AppleGuyMw carry the standard Apple limited warranty. Accessories carry a manufacturer warranty where applicable. AppleGuyMw does not extend or modify Apple's warranty terms. For warranty claims, please contact us and we will facilitate the process with Apple on your behalf.

9. Trade-In Programme

Trade-in valuations are estimates based on the device condition and market value at the time of assessment and are subject to change upon physical inspection. AppleGuyMw reserves the right to revise or withdraw a trade-in offer after inspection. Accepted trade-in values are applied as credit towards a purchase or paid out at our discretion.

10. Intellectual Property

All content on the Service — including text, images, logos, and software — is owned by or licensed to AppleGuyMw and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any content without our prior written consent.

Apple, the Apple logo, iPhone, MacBook, iPad, and other Apple product names are trademarks of Apple Inc., registered in the U.S. and other countries. Use of these marks on the Service is solely for descriptive purposes as an authorised reseller.

11. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms.
• Attempt to gain unauthorised access to any part of the Service or its related systems.
• Transmit any malicious code, viruses, or harmful content.
• Engage in any conduct that disrupts or interferes with the operation of the Service.
• Misrepresent your identity or affiliation.
• Scrape, crawl, or copy content from the Service without authorisation.

12. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, except as required by applicable consumer protection law. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

13. Limitation of Liability

To the fullest extent permitted by applicable law, AppleGuyMw shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, even if advised of the possibility of such damages. Our total liability for any claim arising under these Terms shall not exceed the amount you paid for the relevant order.

14. Indemnification

You agree to indemnify and hold harmless AppleGuyMw, its officers, employees, and agents from any claims, losses, or expenses (including reasonable legal fees) arising from your breach of these Terms or your use of the Service.

15. Governing Law

These Terms are governed by the laws of the Republic of Malawi. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Malawi.

16. Changes to These Terms

We may update these Terms at any time. We will indicate the new effective date at the top of this page and, for material changes, notify you by email or prominent notice on the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
